1. About These Terms

These Terms and Conditions govern the relationship between Bina Saksama ("we", "us", "our") and individuals or organisations ("you", "the client") who engage our consulting services or use our website at binasaks.club.

By booking a session, submitting an enquiry, or using our website, you acknowledge that you have read and understood these terms. If you have questions before proceeding, we welcome you to reach us at [email protected].

These terms are governed by the laws of Malaysia, and any disputes will be subject to the exclusive jurisdiction of the Malaysian courts.

2. Our Services

Bina Saksama provides business consulting services to small business owners in Malaysia. Our current service offerings are:

• Balanced Review — A single consulting session with a written recap note. Priced at RM 350.
• Fair Pricing Review — Two consulting sessions across four weeks, with a written summary. Priced at RM 825.
• Even-Keel Companion — A twelve-month arrangement with monthly meetings, quarterly summaries, and between-session support. Priced at RM 1,550 per year.

The scope and deliverables for each service are as described at the time of booking. We will confirm the agreed scope in writing before or at the start of your engagement.

3. The Nature of Our Advice

Our consulting is advisory in nature. We offer observations, frameworks, and options to support your thinking. We do not make decisions on your behalf, and we do not manage your business operations.

Any conclusions you draw or actions you take based on our sessions remain your own responsibility. We make no representations about specific business outcomes, and we do not use language that suggests particular results are certain.

Our advice is based on the information you share with us. The quality and completeness of what you share directly affects the relevance of what we can offer.

4. Booking and Confirmation

Engagements begin once we have confirmed availability and agreed on scope with you in writing (by email or message). A booking is considered confirmed when:

• We have acknowledged your enquiry and confirmed a session date or start date; and
• Payment has been received in full (or according to any agreed payment schedule).

We will make reasonable efforts to accommodate your preferred timing. If a scheduled session needs to be moved, we ask for at least 48 hours' notice where possible.

5. Fees and Payment

All fees are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless otherwise noted. Payment is due before a session commences, unless a different arrangement has been agreed in writing.

For the Even-Keel Companion, annual fees are payable at the start of the engagement year. Pro-rated arrangements may be agreed at our discretion.

We accept payment via bank transfer or such other methods as we make available. Details will be provided at the time of booking.

6. Cancellations and Refunds

We understand that circumstances change. Our approach to cancellations is as follows:

• Client cancellation with 48+ hours notice: We will offer to reschedule at no additional charge. If rescheduling is not suitable, a refund of the session fee will be issued, less any preparation costs already incurred.
• Client cancellation with less than 48 hours notice: The session fee may be retained to cover the time set aside. We will consider individual circumstances with goodwill.
• Even-Keel Companion early termination: If you wish to end an annual arrangement early, we will refund a pro-rated portion of the remaining period, less any sessions already held and any reasonable costs.
• Our cancellation: If we need to cancel a confirmed session, we will offer a full reschedule or refund, and will endeavour to give as much notice as possible.

Refunds will be processed within 14 working days of a confirmed refund request.

7. Confidentiality

We treat information you share with us in the course of consulting as confidential. We will not disclose it to third parties except:

• Where you have given us explicit permission to do so;
• Where required by Malaysian law or a court order; or
• To trusted service providers who assist us in delivering the service, bound by equivalent confidentiality obligations.

We ask that you also treat any frameworks, tools, or approaches we share with you during sessions as proprietary to Bina Saksama and not for redistribution or resale without our consent.

8. Intellectual Property

All written summaries, session notes, and reports we produce for you are provided for your personal and business use. Ownership of these documents transfers to you upon full payment. The underlying methodologies, templates, and frameworks used in producing them remain the intellectual property of Bina Saksama.

All content on our website — including text, layout, and design — belongs to Bina Saksama. You may share links to our pages but may not reproduce or republish our content without written permission.

9. Limitation of Liability

To the extent permitted by Malaysian law, Bina Saksama's liability for any claim arising from our services is limited to the fees paid by you for the specific service giving rise to the claim.

We are not liable for indirect, consequential, or speculative losses — including lost revenue, missed opportunities, or decisions made based on our advisory input.

Nothing in these terms limits liability for fraud, personal injury, or any other matter that cannot lawfully be excluded.

10. Website Use

Our website is provided for informational purposes. We make reasonable efforts to keep content accurate and current, but we do not warrant that all information is error-free or complete at all times.

We are not responsible for the content of any external websites we may link to. Such links are provided for convenience only.

11. Changes to These Terms

We may update these terms from time to time. The revised date at the top of this page will reflect the most recent update. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.

For active engagements, any material changes to the terms governing that engagement will be communicated to you directly and will not apply retroactively.
